Facts of the Case
On the evening of March 4, 2020, James D. Donaldson III was operating a rented 2013 Ford Mustang convertible southbound on U.S. 441 in Miami Gardens. At the intersection of NW 204 Terrace, Charles D. Andre, driving a 2009 Mercedes GL550 SUV owned by Nancy Herard, failed to yield the right of way during a left turn and collided violently with Donaldson’s vehicle. The collision caused Donaldson’s Mustang to flip airborne and land on its roof in an adjacent parking lot, subsequently catching fire. Donaldson sustained severe injuries and was pronounced dead days later on March 10, 2020.
Legal Issues Raised
The lawsuit alleged negligence and wrongful death against Charles D. Andre, citing his failure to yield as the direct cause of the collision and resulting death. Additionally, the lawsuit pursued vicarious liability claims against Nancy Herard, the vehicle's owner, based on Florida's dangerous instrumentality doctrine and negligent entrustment.
Expert Witness Controversies
Both parties enlisted expert witnesses, and pre-trial motions saw significant debate over expert testimony boundaries. Plaintiff's counsel, The Berman Law Group, successfully moved to limit the testimony of the defense’s primary accident reconstruction expert, Rick Swope, arguing he was unqualified to offer biomechanical and human factors opinions. The motion contended that allowing Swope to testify beyond his area of expertise would introduce unreliable and prejudicial evidence.
Plaintiff's accident reconstruction expert, Miles Moss, offered a detailed reconstruction of the crash, including speed analyses, visibility issues, reaction times, and adherence to traffic regulations.
The Trial and Verdict
The trial commenced on April 7, 2025, presided over by Judge Valerie Manno Schurr. Following several days of testimony from numerous witnesses, including responding medical personnel and law enforcement, the jury deliberated on liability and damages.
On April 15, 2025, the jury returned a verdict finding Charles D. Andre negligent and attributing 66% of the fault for Donaldson's death to him, while Donaldson himself was found 34% negligent. The jury awarded total damages of $7,306,461.95, apportioned to reflect Andre's share at approximately $4.82 million.

$156,461.95 for medical and funeral expenses.
$5 million to Emma Arnett, the decedent’s mother, for past and future pain and suffering.
$2.15 million to James Donaldson II, the decedent’s father, for past and future pain and suffering.
Post-Trial Developments
Following the verdict, Plaintiff's counsel moved for the entry of final judgment, seeking the addition of liability insurer State Farm Mutual as a party defendant, consistent with Florida statutes. They also requested the Court award interest at the statutory rate until full payment of the judgment.
