Case Background: Facts in the Backdrop of the Incident

On June 25, 2021, Daniel Thomas Paul visited the West Hollywood Edition property at 9040 W Sunset Blvd., West Hollywood, California. While descending a staircase in the parking lot, he stepped on a cracked, broken, and uneven step. The surface was defective and deteriorated. He tripped and fell, suffering immediate injury and pain. The premises included areas open to the public and were managed by several business entities and individuals.

Paul alleged that the defendants owned, managed, and controlled the premises in a dangerous and unsafe condition. He claimed they failed to install, maintain, or repair the defective step. He asserted they knew, or should have known, about the hazard through reasonable inspection. The complaint stated they neglected to implement adequate maintenance policies or train staff to meet safety standards. No warnings were posted about the unsafe staircase, placing invitees at risk.

Injury: Plaintiff’s Injuries and Their Impact

The fall caused severe shock and physical injury. Paul sustained harm to his health, strength, and activity. He reported continuing physical and emotional pain. The complaint alleged the injuries were permanent. His condition caused significant distress and limited his daily activities. He sought ongoing medical care.

Damages: Claimed Damages

Paul sought compensation for general damages, including pain and suffering. He claimed medical and hospital expenses. He requested recovery for lost earnings and future earning capacity. He also asked for pre- and post-judgment interest, legal costs, and other relief deemed appropriate by the court.

Defense

Defendant Edition Management, LLC filed a general denial to all allegations in Daniel Thomas Paul’s complaint. The defense asserted multiple affirmative defenses, including that the complaint failed to state a valid cause of action and that any damages should be reduced based on the plaintiff’s comparative fault or the fault of third parties. The defendant also claimed the alleged condition was a trivial defect, that the plaintiff assumed the risk, engaged in wrongful acts, and failed to mitigate damages.

Additional defenses included waiver, unclean hands, obvious danger, lack of privity, statute of limitations, misjoinder of parties, and the existence of an exculpatory clause. The defendant further argued that third-party conduct, superseding causes, misuse, or criminal acts may have caused the incident. It reserved the right to assert additional defenses as discovery progresses and demanded a jury trial.

Dismissal

On June 10, 2025, the Los Angeles County Superior Court granted Defendant Edition Management, LLC’s motion for terminating sanctions against Plaintiff Daniel Thomas Paul. The court found Paul disobeyed its February 27, 2025 order compelling verified discovery responses and payment of $1,890 in sanctions. Despite multiple meet-and-confer attempts, Paul neither responded to the discovery requests nor paid the sanctions.

The court noted Paul’s repeated failures to appear for hearings and comply with discovery obligations, viewing his conduct as abandonment of the case. Because the motion was unopposed, Paul waived any argument against sanctions. The court dismissed his complaint against the defendant with prejudice. The motion for summary judgment was denied as moot. Defendant was ordered to provide notice of the ruling.
