Expert Witnesses in New Mexico
In New Mexico, an expert witness is a person who has specialized knowledge, skill, experience, training, or education that can help the judge or jury understand evidence or determine a fact in dispute.
Rules Governing Disclosure
Under Rule 1-026 NMRA in New Mexico, expert witnesses are disclosed through the discovery process rather than by a separate formal “designation” filing. The rule largely mirrors Federal Rule 26.
For a testifying expert, the opposing party may require disclosure of:
the expert’s identity,
the subject matter of testimony,
the facts and opinions the expert will offer,
the grounds/basis for those opinions,
qualifications and credentials,
compensation arrangements,
publications from the previous 10 years,
prior testimony in other cases during the previous 4 years,
and materials/data considered by the expert.
Admissibility Standards
In New Mexico, the admissibility of expert testimony is governed primarily by a Daubert standard-style reliability framework. An expert may testify if the witness is qualified by knowledge, skill, experience, training, or education, and if the testimony will assist the trier of fact in understanding the evidence or determining a fact in issue.
New Mexico courts require that expert testimony be both relevant and reliable. The testimony must be based on sufficient facts or data, must be the product of reliable principles and methods, and the expert must have reliably applied those principles and methods to the facts of the case. The trial judge acts as a gatekeeper and determines whether these requirements are satisfied before the testimony may be presented to the jury.
Attorney–Expert Communication Protection
In New Mexico, attorney–expert communications are partially protected under Rule 1-026 NMRA, particularly for retained testifying experts. Draft expert reports and communications reflecting attorney mental impressions, legal theories, or litigation strategy are generally treated as protected work product. The rule is designed to allow attorneys and experts to collaborate without fear that every discussion or revision will automatically become discoverable.
However, the protection is not absolute. Communications relating to the expert’s compensation, facts or data provided by counsel that the expert considered, and assumptions supplied by the attorney and relied upon by the expert remain discoverable. Courts allow discovery into these areas because they directly affect the basis and reliability of the expert’s opinions.
Compensation
In New Mexico, expert witnesses are generally entitled to reasonable compensation for their time and professional services. Rule 1-026 NMRA allows discovery into the compensation paid to testifying experts, and parties are typically required to disclose the expert’s fee arrangements as part of expert discovery.
New Mexico does not impose a fixed statutory cap on ordinary expert witness fees in civil litigation. Experts may charge for activities such as record review, report preparation, depositions, consultations, and trial testimony, and the amount is usually determined by the expert’s qualifications, specialty, experience, and the complexity of the matter. Courts may, however, examine whether the fees are reasonable, particularly in disputes over discovery costs or deposition expenses.
Limits on Number of Expert Witnesses
New Mexico does not impose a fixed numerical limit on the number of expert witnesses a party may present in civil litigation. Instead, the admissibility and scope of expert testimony are controlled through the trial court’s case-management authority, the rules of evidence, and considerations of relevance, efficiency, and undue prejudice.
Out-of-State Expert Qualification
An expert does not need to reside, practice, or hold a professional license in New Mexico merely to provide expert testimony in a New Mexico proceeding. Courts focus primarily on whether the witness possesses the necessary knowledge, skill, experience, training, or education relevant to the subject matter of the testimony.
