Case Background
On June 30, 2021, residents of East 27th Street in Los Angeles faced a neighborhood emergency. Police and bomb squad technicians from the Los Angeles Police Department responded to reports of illegal fireworks stored near San Pedro Street. City officials moved the fireworks into a containment vessel for detonation. The neighborhood was densely populated with homes, cars, and families. Plaintiffs Luisa Bonilla, Benjamin Hernandez Sotelo, Lessly Alejandra Rios, and minors Alisson and Viktor Sotelo lived nearby.
Cause
The LAPD Bomb Squad miscalculated the weight of the fireworks. They loaded the containment vessel far above its safety rating. City officials and employees failed to properly plan, inspect, or secure the explosives. When they attempted to detonate the fireworks, a massive explosion tore through the neighborhood. The blast shattered windows, damaged homes, and destroyed cars. The Plaintiffs argued the City ignored safety standards, best practices, and its duty to protect residents.
Injury
The explosion seriously injured the Plaintiffs. They suffered harm to their health, strength, and activity. Their nervous systems were affected, leaving them in pain and distress. The blast caused lasting physical and emotional trauma. Plaintiffs reported ongoing suffering and possible permanent disabilities. Their lives and routines were disrupted by both physical injuries and emotional strain from the violent incident.
Damages
Plaintiffs incurred substantial medical expenses for treatment of their injuries. They expected to need further medical care in the future. They sought compensation for pain, suffering, and loss of enjoyment of life. They also claimed property damage, loss of use, and other related expenses. Economic damages included lost earnings or earning capacity. They argued the City’s conduct forced them to bear heavy financial and personal burdens.

Counsel for Plaintiffs: Victor Alexandroff | Daniel C. Ghyczy
Defendant(s): City of Los Angeles
Counsel for Defendant: Derek Paul Cole | Catherine Sun
Claims
The complaint alleged two causes of action. First, Plaintiffs claimed negligence against the City of Los Angeles, LAPD bomb squad technicians, and Does 1 to 50. They argued Defendants failed to exercise reasonable care in planning and executing the detonation. Second, they alleged violations of California Government Code §§ 815.2(a) and 820(a). They claimed the City and its employees negligently owned, operated, and inspected the containment vessel, creating liability for a dangerous incident.
Defense
The Defendant, City of Los Angeles, denied all allegations in the Plaintiffs’ complaint and raised multiple affirmative defenses. The City argued that Plaintiffs’ own negligence, or the negligence of third parties, caused or contributed to their alleged damages. It asserted defenses of assumption of risk, failure to mitigate damages, failure to wear seatbelts, and statutory immunities under California law. The City also claimed the action was barred by the statute of limitations, the California Tort Claims Act, laches, unclean hands, and preclusion doctrines. Additionally, it invoked offset, collateral source rule, unavoidable accident, and emergency vehicle exemptions, ultimately seeking dismissal of the complaint and recovery of costs.
Settlement
The parties reached a global settlement resolving all claims. On July 15, 2024, Plaintiffs’ counsel filed a Notice of Settlement of Entire Case, indicating that the matter had settled for $475,000. The agreement was conditional, with dismissal of the action to follow upon completion of specified terms within six months, no later than January 15, 2025. The filing resulted in the cancellation of further proceedings, including the final status conference and trial dates, pending formal dismissal.
