
Jury Rejects Supplier's Unpaid Invoice Claim, Backs Buyer
A California supplier sued a New York-based online discount retailer for over $125,000 in unpaid invoices, claiming it delivered goods and services that were never paid for. The retailer countersued, alleging the supplier misrepresented where its inventory was located and routinely shipped orders late, damaging its reputation with customers. After trial, the jury found that while the retailer had indeed requested the goods and services, the supplier failed to prove it actually delivered them as required. The jury also found the supplier breached the parties' Master Supplier Agreement and that the retailer was entitled to liquidated damages, though it declined to specify a dollar amount, instead writing in "Atty Fees for Defense." The Court entered judgment for the retailer on all claims, with no money judgment awarded to either side, and granted the retailer the right to pursue a motion for attorney's fees and costs.
