
Takeda Amitiza $885M Pay-for-Delay Antitrust Jury Verdict
A federal jury in Boston returned a massive $885 million antitrust verdict against Takeda Pharmaceutical Company, finding the drugmaker liable for orchestrating an illegal "pay-for-delay" scheme to protect its multi-million dollar constipation medication, Amitiza. The class-action lawsuit, filed in 2021 by a coalition of direct purchasers, insurers, and major retail pharmacy chains like CVS and Walgreens, alleged that Takeda and its partner, Sucampo, executed an improper $210 million settlement with Par Pharmaceutical. The agreement artificially delayed the market launch of a cheaper generic equivalent until 2021, forcing buyers to pay heavily inflated prices for years. Under federal antitrust rules, the Court's final judgment could automatically triple the total liability to approximately $2.5 billion.
